Terms and Conditions of purchasing an online Course or Service

Introduction

These Terms and Conditions govern the purchase and use of online training courses or services offered by The IT Strategy Coach Ltd. incorporated in England and Wales with registered company number 15692852, registered office 62 The Street, Ashtead, Surrey, United Kingdom, KT21 1AT (“we”, “us”, “our”). By completing a purchase on our Kajabi platform, you (“you”, “the customer”) agree to these terms.

These terms apply whether you are:

  • A consumer (purchasing for personal use), or
  • A business customer (purchasing on behalf of a company or organisation).

Certain additional rights apply only to consumers, as explained below.

 

Services and Access

  • Online courses are delivered through our Kajabi platform. Access is provided to the named purchaser or authorised learner(s) only.
  • Live coaching sessions are delivered online (e.g. via Zoom or Microsoft Teams, the Kajabi platform or other online meeting platforms) at scheduled times.
  • Accounts and access must not be shared, transferred, or resold.
  • Recording of coaching sessions is not permitted without our prior written consent.
  • We reserve the right to suspend access if misuse or unauthorised sharing is detected.

 

Licence and Access to Online Courses

  •  Licence Granted
    When you purchase an online course or live coaching service from The IT Strategy Coach, you are granted a personal, non-transferable licence to access and use the materials for your own educational purposes.
  •  Duration of Access
    We intend to provide ongoing access to purchased courses and resources for as long as they remain available on our chosen hosting platform. This is sometimes described as “lifetime access”, meaning for the lifetime of the course itself rather than your lifetime.
  •  Platform Dependency
    Our online courses are delivered via third-party hosting platforms (such as Kajabi). Continued access is therefore dependent on the ongoing availability and operation of those platforms, and on our continued use of them.
  •  Changes, Migration or Withdrawal
    We reserve the right to change, migrate, suspend or withdraw courses at our discretion, including (but not limited to) if:
    • we cease trading;
    • we discontinue or replace our hosting platform; or
    • we decide to retire or update a course.
    • In such cases, we will use reasonable endeavours to give notice and, where feasible, to provide an alternative means of access. However, we cannot guarantee indefinite or perpetual availability.
  •  Downloads and Materials
    Where course materials are made available for download, you may retain a personal copy for your own continued use. Downloaded materials remain subject to the licence restrictions in these Terms and Conditions.
  • Limitation of Liability for Availability

To the fullest extent permitted by law, we are not liable for any losses arising from the unavailability of online courses or coaching services beyond our statutory obligations under the Consumer Rights Act 2015 and other applicable law.

 

Pricing and Payment

  • Prices are shown in GBP and will state whether VAT or other sales tax is included or added at checkout.
  • Payment is taken at the point of order through Kajabi’s integrated processors.
  • For coaching sessions, access will be confirmed once payment is received and a session has been scheduled.
  • Access to training courses is granted upon successful payment.

 

VAT and Tax

  • If you are a consumer in the UK, VAT (if applicable) will be included at the standard rate.
  • If you are a business, VAT will be charged where applicable and shown on your invoice.
  • If you are a customer elsewhere in the world, the Kajabi Payments platform will determine and apply the relevant sales taxes.
  • You are responsible for any additional local taxes or charges.

 

Cancellation and Refunds

a. Online Courses (digital content)

  • If you are a consumer, you have a legal right to cancel within 14 days of purchase (the “cooling-off period”) unless you have accessed or begun downloading/streaming the course.
  • By starting the course immediately after purchase, you agree to waive this right.
  • If you are a business customer, orders are non-cancellable and non-refundable once confirmed.

b.  Live Coaching Sessions (services)

  • Coaching sessions booked by consumers are also subject to the 14-day cooling-off period. If you request a session to take place during this period, you agree that your cancellation right ends once the session has been delivered.
  • Coaching sessions already delivered are non-refundable.
  • Sessions cancelled by you with more than 24 hours notice may be rescheduled.
  • Sessions cancelled with less than 24 hours notice, or where you do not attend, may be charged in full.
  • For business customers, sessions are non-cancellable and non-refundable once booked, unless otherwise agreed in writing.

c.  Discretionary Refunds

  • We may, at our discretion, offer refunds beyond statutory rights.
  • Refund requests must be submitted in writing to [email protected]

 

Intellectual Property

  • All course materials, coaching resources, and related content remain the intellectual property of The IT Strategy Coach Ltd.
  • Purchasers are granted a non-exclusive, non-transferable licence to access the content for personal or internal business use only.
  • You must not copy, distribute, modify, or resell any materials without our prior written consent.
  • You may not record, reproduce, or share coaching sessions without explicit permission.

 

Liability

  • Our courses and coaching are provided “as is” for educational and personal/professional development purposes only.
  • We do not guarantee specific outcomes or results.
  • For consumers: Nothing in these terms limits your statutory rights. We are not liable for any losses arising due to the use of our of online courses or coaching services beyond our statutory obligations under the Consumer Rights Act 2015 and other applicable law.
  • For business customers:
    • Our liability is limited to the total amount paid for the Service giving rise to the claim in the 12 months preceding the claim.
    • We are not liable for indirect, special, or consequential losses, including (but not limited to) loss of profits, data, or goodwill.

 

Data Protection

  • We process your personal data in accordance with our Privacy Policy https://www.itstrategy.coach/privacy-policy
  • Kajabi, as platform provider, also processes data in its role as service provider under its own terms and conditions.

 

Governing Law

  • These terms are governed by the laws of England and Wales.
  • Consumers may bring claims in their local courts if outside England and Wales.
  • Business customers agree to the exclusive jurisdiction of the courts of England and Wales.
